MedTech HR News: New OT Rule Will Not Take Effect on December 1st.
Federal Judge, Amos Mazzant granted a preliminary injunction blocking the new federal overtime rule which would have raised the Fair Standard’s Act’s (FLSA’s) salary threshold for exempt employees from $23,660 to $47,476.
“A preliminary injunction preserves the status quo while the court determines the department’s authority to make the final rule as well as the final rule’s validity,” Mazzant said.
The Labor Department is looking at its legal options but faces an uphill battle.
If you’ve already made changes to comply with the proposed salary threshold or have already reclassified employees, you will probably want to keep those changes in place. If you delayed making any changes, you may want to wait until the litigation plays out.
